Also may I raise the issue whether or not Milk should be considered original? If you watch The Life And Times of Harvey Milk it is obvious they lifted heavily from the documentary, to the point they give it a special thanks as one of the first things in the credit. The idea that Dustin Lance Black didn't "adapt" from the documentary is a little hard to believe considering how closely it follows the doc, and how much it lifts from it directly. I watched the movie yesterday, and I was wondering the same. I haven't seen the doc and can't vote on that, though.

Had it said 'Based on the documentary...' I'd agree with you but it doesn't. It's based on a life really.

Well the thing is the semi-dishonesty coming from campaigns, or filmmakers, is common in order to place a film in a certain category. This is an issue where I don't think you can trust the filmmakers. Moonlight was placed original at first, but was eventually moved to adapted. I believe Loving also had to be moved into adapted, for consideration, when it was recognized how much it took from a documentary on the subject. Milk acknowledges the documentary in the credits and I think if more scrutiny had been placed on Black's screenplay it probably would've been forced into adapted (where it would've lost to Slumdog).
If we just trusted the filmmakers then Fistful of Dollars needs to be looked at as an original screenplay, as Leone didn't recognize it was based on anything until he was sued over it.

I feel ya man, I really do. I dunno, I personally just tend not to get into this issue too deeply because it'd just make me go nuts to think about every screenplay's placement in such a way, I'd goddamn question every movie Which is why I just tend to believe the credits, unless it's a special case like "Moonlight" or something when it literally was an adaptation of a play. Again, with something like "Milk" it's a bit tough for me to agree with you because I consider it based on a life rather than a doc.
